These Terms & Conditions ("Terms") govern your use of the Underw0rld Collectibles website and sign-up list (together, the "Site"). "Underw0rld Collectibles," "we," "us" and "our" refer to the business operating this Site. By using the Site or submitting the sign-up form, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
1. Who can use the Site
You must be at least 18 years old to submit the sign-up form. The Site is not directed to children under 13, and we do not knowingly collect personal information from them.
2. What the Site is
The Site is a pre-launch page. It describes Underw0rld Collectibles and lets you join a list for news, inventory updates and upcoming events. Nothing on the Site is an offer to sell any item, and joining the list does not reserve inventory, guarantee availability or pricing, or create any obligation to buy.
3. Signing up
When you sign up you agree to give accurate information that belongs to you: your own name, an email address you control and, if you choose to give one, a phone number you are the subscriber or customary user of. Do not sign up anyone else.
4. Email messages
By checking the consent box and submitting the form, you agree to receive marketing and informational emails from us. Every marketing email includes a working unsubscribe link and our postal address. You can unsubscribe at any time using that link or by contacting us, and we will honor the request within 10 business days.
5. Text messages
Text messages are optional. We will text you only if you give a mobile number and separately check the box agreeing to receive texts. If you do:
- You agree to receive recurring marketing and informational text messages from Underw0rld Collectibles at the number you gave, which may be sent using an automatic telephone dialing system or other automated technology.
- Consent to receive texts is not a condition of buying anything.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to any message to cancel. Reply HELP for help, or contact us using the details below.
- Carriers are not liable for delayed or undelivered messages.
- Tell us if you change or give up your number so we can stop texting it.
6. Intellectual property
The Underw0rld name, logo, artwork, text and design of the Site belong to us or our licensors and are protected by copyright, trademark and other laws. You may view the Site for personal, non-commercial use. You may not copy, modify, distribute or create derivative works from it without our written permission.
Names, characters, brands and logos of third parties that may appear in connection with collectibles belong to their respective owners. Their appearance does not mean those owners sponsor or endorse us.
7. Acceptable use
You agree not to misuse the Site. That includes submitting false information, submitting information about another person, using bots or scripts to submit the form, attempting to access our systems or data without authorization, interfering with the Site's operation, or using the Site in violation of any law.
8. Links to other sites
The Site links to third-party platforms such as social media services. We do not control those platforms and are not responsible for their content, terms or privacy practices.
9. Disclaimers
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or secure, or that any information on it, including launch dates, is accurate or complete.
10. Limitation of liability
To the fullest extent permitted by law, Underw0rld Collectibles and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from or related to your use of the Site. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars (US $100). Some states do not allow certain limitations, so some of these limits may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Underw0rld Collectibles and its owners, employees and agents from any claims, losses and expenses, including reasonable attorneys' fees, arising from your breach of these Terms or your misuse of the Site.
12. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in Harris County, Texas, and you consent to the jurisdiction of those courts. Nothing in this section limits any consumer rights you have under the law of your state of residence that cannot be waived by contract.
13. Future purchases
When our store opens, purchases will be governed by separate terms of sale, shipping and return policies that will be presented at that time. These Terms will continue to govern the Site and the sign-up list.
14. Changes to these Terms
We may update these Terms. When we do, we will change the effective date and version above. Changes apply from the date they are posted. If a change is material and affects how we contact you, we will tell you by email before it takes effect.
15. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms and the Privacy Policy are the entire agreement between you and us about the Site.

Privacy Policy

This Privacy Policy explains what personal information Underw0rld Collectibles ("we," "us," "our") collects through this website and sign-up list (the "Site"), how we use it, who we share it with, and the choices and rights you have. We are based in Texas, United States.
1. Information we collect
We collect only what you give us in the sign-up form, plus a record of your consent:
- Contact details: your name, your email address and, if you choose to give it, your phone number.
- Consent records: whether you agreed to receive emails, whether you agreed to receive text messages, the version of the Terms you accepted, and the date and time you signed up.
- Source: the website address the form was submitted from.
We do not collect payment information, precise location, government identifiers or other sensitive personal information through the Site.
2. How we use your information
- To send you the news, inventory updates and event announcements you signed up for, by email and, only if you opted in, by text message.
- To keep a record of your consent and honor your unsubscribe and opt-out requests.
- To respond to you when you contact us.
- To protect the Site against spam, fraud and abuse, and to comply with the law.
3. Email
Every marketing email we send identifies us as the sender, includes our postal address and includes a working unsubscribe link. You can unsubscribe at any time and we will process the request within 10 business days.
4. Text messages
We send text messages only to people who gave a mobile number and separately agreed to receive texts. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. Mobile phone numbers and text-messaging consent are not sold, rented or shared with third parties or affiliates for their own marketing purposes.
5. How we share information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We disclose it only to:
- Service providers that process it for us under contract, such as the cloud provider that stores our sign-up list (Google) and the email and text-messaging services we use to send messages.
- Authorities or other parties when the law requires it, or when necessary to protect our rights, our customers or the public.
- A successor business if Underw0rld Collectibles is reorganized, merged or sold, in which case this Policy continues to apply to your information unless you are told otherwise.
6. Cookies and tracking
This Site does not use advertising cookies, analytics trackers or tracking pixels. Because we do not track visitors across sites, the Site does not change its behavior in response to browser "Do Not Track" or Global Privacy Control signals. If we add analytics or advertising tools in the future, we will update this Policy first.
7. How long we keep it
We keep your contact details for as long as you stay on the list. If you unsubscribe or ask us to delete your information, we remove it from our active list and keep only the minimum record needed to make sure we do not contact you again and to show that we complied with the law, generally for up to four years.
8. Your choices and rights
Wherever you live, you can ask us to:
- tell you what personal information we hold about you and give you a copy;
- correct information that is wrong;
- delete your information;
- stop sending you emails, text messages or both.
To make a request, email contact@underw0rld.com from the address you signed up with. We will verify the request using the information we already hold, respond within 45 days, and will not treat you differently for exercising any of these rights. If we decline a request, you may reply to appeal the decision, and we will respond to the appeal within 60 days. You may also use an authorized agent to make a request on your behalf.
State privacy laws. Residents of California, Texas, Virginia, Colorado, Connecticut, Utah, Oregon, Montana and other states with consumer privacy laws have rights of access, correction, deletion, portability and opting out of the sale of personal information, targeted advertising and certain profiling. We do not sell personal information or use it for targeted advertising or profiling. We extend the rights described above to everyone, whether or not a particular state law applies to a business of our size. If you are not satisfied with our response to an appeal, you may contact your state attorney general.
California "Shine the Light." We do not disclose personal information to third parties for their direct marketing purposes.
9. Children
The Site is not directed to children under 13, and you must be 18 or older to sign up. We do not knowingly collect personal information from children under 13. If you believe a child has given us information, contact us and we will delete it.
10. Security
We use reasonable administrative and technical safeguards, including encrypted transmission and access-restricted storage, to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a breach affecting your information occurs, we will notify you as required by law.
11. Visitors from outside the United States
The Site is operated in the United States and intended for people in the United States. If you sign up from another country, your information will be transferred to and stored in the United States.
12. Changes to this Policy
We may update this Policy. When we do, we will change the effective date and version above. If a change materially affects how we use information we already hold, we will tell you by email before it takes effect.
